TERMS OF SALES

Preamble

The company MAJESTICFILATURES RETAIL (the “Company” or “MAJESTICFILATURES RETAIL”) is responsible for operating the websites www.majesticfilatures.com and www.majesticfilatures.be (the “Site”). For the purposes of this Agreement, it is agreed that the customer and MAJESTICFILATURES RETAIL will be referred to as the “Parties” and individually referred to as a “Party”. These conditions (hereinafter the “General Conditions of Sale”) govern all sales of products made by MAJESTICFILATURES RETAIL from the Site (the “Products”) to any natural and non-commercial person (the “Customer”) making a purchase. on the site.

ARTICLE 1: OBJECT

The purpose of these General Conditions of Sale is to define the conditions under which the Products are sold by MAJESTICFILATURES RETAIL to the Customer. They thus regulate the different stages of completing the sale: from the placing of the order by the Customer to delivery of the Product. MAJESTICFILATURES RETAIL reserves the right to modify the General Conditions of Sale at any time by publishing a new version on the Site. The applicable General Conditions of Sale are those in force on the Site on the date the order is placed by the Customer. Placing an order for a Product offered on the Site and checking the box indicating that the Customer accepts the General Conditions of Sale implies the Customer's full acceptance of the General Conditions of Sale.

ARTICLE 2: PRODUCTS

2.1 Products

The Products offered for sale by MAJESTICFILATURES RETAIL are those which appear on the Site on the day of its consultation. The photographs illustrating the Products are not contractual, each Product is also the subject of a descriptive sheet. 2.2 Guarantees

The Company undertakes to deliver Products that comply with applicable French and European provisions, in particular relating to the safety and health of people and in particular to the legislation on regulated chemical substances.

Legal guarantees

Any defects in conformity of Products purchased on the Site are guaranteed by the Company under the conditions of Article L. 217-4 et seq. of the Consumer Code and hidden defects in the item sold under the conditions provided for in Articles 1641 et seq. of the Civil Code. As part of the implementation of the legal guarantee of conformity, the Customer:

- benefits from a period of two (2) years from the delivery of the goods to take action.

- can choose between repair or replacement of the Product, in accordance with article L. 217-9 of the Consumer Code. We may, however, choose not to proceed according to the Customer's choice if this choice results in a cost that is manifestly disproportionate with regard to the other method, taking into account the value of the goods or the importance of the defect. If repair or replacement of the Product is impossible, the Customer can choose between restitution of part of the price or termination of the contract, in accordance with article L. 217-10 of the Consumer Code;

- is exempt from providing proof of the existence of the lack of conformity of the goods during the 24 months following delivery of the goods.

- may decide to implement the guarantee against hidden defects in the item sold within the meaning of article 1641 of the Civil Code and in this case, he may choose between canceling the sale or reducing the sale price in accordance with article 1644 of the Civil Code.

If you receive defective or damaged Products, please report these defects to us immediately or to the carrier. Failure to report said defects does not deprive you of the benefit of legal guarantees. The Company will bear all logistical costs linked to their exchange. The Products are returned to the Company under the responsibility of the Customer. The Company cannot be held responsible for returned products that have been lost or damaged during delivery.

ARTICLE 3: PRICE

Prices are indicated in euros, all taxes included, excluding delivery costs.

The company reserves the right to modify its prices at any time but the products ordered are invoiced at the price in effect when the order is placed.

Delivery costs are communicated to the Customer on the order summary before validation of the latter; they are expressed all taxes included, except special offer. These costs are the responsibility of the Customer and are invoiced in addition to the sales price of the products.

The transfer of risks of loss and deterioration of the products will be carried out after delivery and receipt of the products by the Customer.

ARTICLE 4: ORDER AND PAYMENT OF PRODUCTS

4.1 Placing the order

- Step 1: the Customer checks the contents of his basket, he can then modify his order (product, size, quantity).

Once the order has been verified and, if necessary, modified, the Customer selects their country of delivery then validates their basket in order to finalize their order by clicking on the “finalize my order” button.

- Step 2: The Customer registers on the Site or identifies himself.

- Step 3: The Customer verifies his delivery address, accepts the General Conditions of Sale by checking the box corresponding to the acceptance of the general conditions then by clicking on the button "validate and pay for my order" he accesses the banking partner's website .

- Step 4: Entering bank details:

Payment is made online by credit card on the platform of MAJESTICFILATURES RETAIL's banking partner, or Paypal on the platform

4.2 Order confirmation

Upon acceptance of payment, the Customer will receive an email confirming their order. The confirmation will include all the items ordered, the billing and delivery address, as well as a copy of the invoice referring to the General Conditions of Sale. The validation of the order by the Customer and the order confirmation sent to the Customer by email by MAJESTICFILATURES RETAIL following acceptance of payment constitute the conclusion of a sales contract between the Parties and acceptance of the General Conditions of Sale. 4.3. Payment

The price of Products purchased is payable in full in cash on the day the customer places the order. Payment is made online by credit card (CB / VISA / MASTERCARD / AMEX) or Paypal at the time of validation of the order by the Customer. Payment can be made in 3 installments free of charge with our partner Alma, from 150€ purchase, for France, Germany and Spain. If you pay for your order in several installments, you accept THE GENERAL TERMS AND CONDITIONS OF PAYMENT WITH ALMA .

The payment authorization request is made at the time of validation of the order on the Site. After confirmation of your payment by our payment provider, your bank account or your Paypal account will be debited for the total amount of your order. In the event of non-payment, an incorrect address or any other problem on the Customer's account, MAJESTICFILATURES RETAIL may block the Customer's order until the problem is resolved. Transactions carried out on the Site are secured by the payment system of MAJESTICFILATURES RETAIL's partner, HSBC bank. All information exchanged to process the payment is encrypted using the SSL (Secure Socket Layer) protocol. This data cannot be detected, intercepted or used by third parties. At no time does the Customer's financial data pass through the MAJESTICFILATURES RETAIL computer system. The bank verifies that the connection with the customer's browser is secure before sending the payment form to the banking institution carrying out the financial transaction.

In the event of a technical problem preventing payment from being made, you will receive an error message from the bank. You will then have to renew the payment authorization request, you will only be debited for the payment amount once.

In the event of non-payment or any other problem on the Customer's account, the Company may block the Customer's order until the problem is resolved. In the event of fraudulent use of their bank card on the site, the Customer must contact their bank, which issued the card used. 4.4. Archiving the order

ARTICLE 5: DELIVERY

The Company uses the services of LAPOSTE, CHRONOPOST and UPS for the shipping and delivery of products ordered by the Customer. Deliveries take place within the time specified when placing the order.

The delivery time corresponds to the shipping time indicated at the time of placing the order, to which is added the preparation time.

The Customer is informed that prices and delivery times vary depending on the country defined by the customer as the delivery address at the time of his order and which is authentic. Depending on the Customer's selection, the corresponding price will be indicated automatically in the order process and will appear on their order summary.

If your country of delivery is located outside the EU or in Overseas Territories, your package may be charged customs, import duties or various taxes in force in your country of residence which are not included in the final amount of your order. If you receive an email or call regarding this, you are responsible for paying these fees to collect your order. If you refuse to pay these fees, your order will be returned to us. We will then proceed to a partial refund of your order because we will be obliged to deduct delivery costs and customs fees.
